Medical Malpractice Birth Injuries
Medical Malpractice occurs when patients are injured due to the actions or inactions of doctors or other health care professionals. Birth-Related Medical Malpractice occurs when a staff member fails to use reasonable care and acts negligently causing injury to the mother or child. Negligence during delivery is one of the leading causes of Medical Malpractice lawsuits. Here is a list of some common injuries that may occur during the birthing process:
- Erb’s Palsy is a nerve-related injury that may occur due to the neck or shoulder of the baby being stretched too far during delivery. The condition results from damaging the delicate nerves near the neck that causes numbness, weakness, and loss of motion in the arms. The degree of severity varies, however, some newborns may need to attend physical therapy or surgery if there are no improvements between three to six months.
- Birth Fractures are common clavicle or collarbone fractures that can occur during the delivery of the newborn. These fractures may be avoided if the doctor takes proper action and performs a C-section delivery when appropriate.
- Caput Succedaneum is caused by pressure on the baby’s head during a difficult or prolonged head-first delivery or the scalp of the newborn will swell due to a vacuum extraction procedure.
- Hypoxic-Ischemic Encephalopathy occurs when the baby does not receive enough oxygen to the brain. The result may be brain damage, developmental problems, epilepsy or even death.
Any of these conditions might be cause to file a Medical Malpractice lawsuit if the injury sustained by the mother or child was due to the negligent care provided by the medical professional. I met with Harry Brown personally and he sat with me for 20 minutes at our initial consultation to explain everything. He even called after my surgery to see how I was doing. I met with him several more times after that and was kept informed about my case throughout. I highly recommend Harry Brown as an attorney.
