Cobb County, Georgia (August 24, 2023) – According to police, a 76-year-old Marietta man was killed Sunday night when a car hit him as he crossed Austell Road in central Cobb.
The man was crossing Austell Road near Favor Road outside the marked crosswalk around 9:12 p.m. Sunday when he was hit by a red 2001 Jeep Cherokee driven by a 71-year-old man from Marietta.
The pedestrian suffered serious injuries and was taken to Wellstar Kennestone Hospital, where he later passed away from his injuries.
The incident remains under investigation.
I met with Harry Brown personally and he sat with me for 20 minutes at our initial consultation to explain everything. He even called after my surgery to see how I was doing. I met with him several more times after that and was kept informed about my case throughout. I highly recommend Harry Brown as an attorney.
Pedestrian Accidents in Georgia
Pedestrian accidents pose a serious risk. Pedestrian accidents are typically more serious than other types of accidents because a car can seriously injure an unprotected person, even at a low speed. As a result, the risk of pedestrian fatalities increases. Almost all pedestrian accidents result in injuries, and many of them result in wrongful death.
Accidents involving pedestrians are investigated and handled in the same way that accidents involving vehicles are. Accident victims and their families are permitted by law to seek financial compensation for any losses sustained as a direct result of the accident.
Despite having the right of way, pedestrians are sometimes blamed for accidents. Pedestrians who cross the street illegally, unexpectedly, and without warning may be partially or entirely to blame, even if they sustain severe injuries as a result of the collision.
If the pedestrian was to blame for the collision, the driver of the car may be entitled to compensation for costs incurred as a result of the collision, such as the cost of having the car repaired.
When a vehicle hits a pedestrian, the driver is almost always found to be at least partially at fault. This is because it is the driver’s responsibility to keep an eye out for pedestrians.
